Privacy Policy

On May 25, 2018, the European General Data Protection Regulation (GDPR) came into force. This regulation replaces country-specific laws and applies to all companies and organizations that process the personal data of EU residents. The core aim of the GDPR is to make it easier for EU residents to understand what personal data organizations hold about them and how they are used. In short, it gives individuals more control over their personal data. Design8 strongly supports this transparency and is committed to operating in full compliance with the GDPR.

Design8 is a distributor of 3D software, providing training and support to our valued customers and the customers of our resellers. Essentially, we interact with three parties:

  • You, the end user of the software, who purchase software licenses either directly from us or through one of our resellers.
  • The reseller from whom you purchase the software licenses, and to whom Design8 sells the software licenses.
  • The supplier from whom Design8 purchases the software licenses.

We acknowledge that the GDPR is targeted towards natural persons, not organizations. Design8 operates primarily on a business-to-business basis, so we mostly register company information. Often, we deal with natural persons who act on behalf of an organization. In such cases, the registered information is typically neither personal nor privacy-sensitive. However, sometimes we register personal email addresses and provide software to individuals, mainly students and teachers.

We also recognize that we mainly register data from paying customers to whom we provide services. In these cases, the registration of data is part of a business agreement, making this registration both legal and necessary for conducting good business practices.

Finally, we assert that the data we register is rarely sensitive personal information. We primarily link license data to contact details and technical information (e.g., the type of computer and operating system being used). Please read further for more clarification on this. We never collect more data than is absolutely necessary and do not track or profile individuals.

Design8 bv is a limited corporation (BV) based in the Netherlands, registered with the Dutch Chamber of Commerce under number 11063158. In addition to this data, we also record non-personal information such as the computer platform, industry and sector, products purchased, and the reseller from whom the licenses were acquired. While we do not consider this data to be personal, it is essential for conducting business and providing effective service.

Where We Obtain Your Personal Data

We process data that we receive from the following sources:

If you download and try software, view a webinar, visit us at a trade show, or want to stay informed, you usually fill out a form with your information, giving us consent to contact you.

Why Do We Process Your Personal Data?

We process your personal data to associate you with your reseller and the software licenses you have purchased or been granted. This is done solely for the purpose of managing your licenses and ensuring you receive the best possible service and support. We do not use your data to harm your interests or to learn more about you personally.

It’s essential for us to keep track of which customers use which products purchased through which resellers. This helps us provide timely and relevant updates, such as price increases or new software versions, in a professional manner that benefits you.

When you contact us for technical support, we need to know which products and versions you are using, the environment in which they are used, and where they were purchased. This information allows us to assist you effectively.

Our relationship is purely professional and based on a paid agreement. Responsibilities on both sides are outlined in our General Terms and License Agreements, which you, or your parent or guardian if you are under 16, agree to before installing or starting the software.

Unlike physical products like cars, which are easily identifiable and can only be in one place at a time, software licenses are different. A software license grants usage rights to an individual or organization and can be used at multiple locations simultaneously. This is why it is important for us to link you to your license and verify your identity. This also helps us determine your eligibility for free upgrades, promotions, or special licenses like those for students or teachers.

You have the right to object to the processing of your personal data at any time. Please see below for details.

Who Do We Share Your Personal Data With?

As outlined earlier, our suppliers have a legitimate interest in knowing the contact details of licensed customers. Since a software license is a personal right, it’s necessary to share personal data to match users with their licenses. As long as Design8 operates in compliance with GDPR, we are permitted to share data with countries including Andorra, Argentina, Canada (commercial organizations), Faroe Islands, Guernsey, Israel, the Isle of Man, Jersey, New Zealand, Switzerland, Uruguay, and the USA.

Who Has Access to Your Personal Data?

All Design8 employees have access to your personal data as needed to perform their roles effectively. Our employment contracts include agreements to respect GDPR regulations, and our employees are fully aware of their obligations and your rights under the GDPR.

Our suppliers, listed in the table above, are also GDPR-compliant. We ensure their adherence through contractual agreements or procedures.

Where Do We Store Your Personal Data?

We use a standard database system that conforms to industry standards for recording, processing, and storing your personal data. We create both internal and external backups to protect your data in case of incidents like fire or theft. These backups are static and are not processed under GDPR regulations.

If you purchase software directly from our webshop, we use standard webshop software that complies with market standards. You can create, modify, and delete your own data through your account. Your data is securely stored on our own server, managed by a Dutch data provider who respects GDPR and does not access your personal data. For payments made through iDeal, a Dutch payment specialist processes your payment data automatically and also adheres to GDPR.

How Long Do We Keep Your Personal Data?

We retain your personal data as long as you have an active software license. After the license expires, we comply with legal requirements for record-keeping, which was seven years as of 2018. After this period, we anonymize your data.

If your reseller does not inform you that your data is being shared with us, we will send you an automated message within 30 days of receiving your personal data from our resellers or suppliers, indicating the source organization.

  • Access to the personal data we process.
  • Verification of the accuracy of your data.
  • Corrections to your data.
  • Additions to your data.
  • Transfer of your data to a third party.

Upon request, we will provide your personal data in a standard, computer-readable electronic format.

We Inform Our Resellers

We instruct our resellers to be transparent about the collection and sharing of your personal data when you order through them. We also encourage them to direct you to our privacy information.

We Secure Your Data

Local data is protected and encrypted on our servers and backups to prevent unauthorized access. All systems require employees to log in with regularly changed passwords and automatically log out after periods of inactivity.

Our external cloud services for sharing, storing, and backing up your data are protected according to current laws and market standards, and they respect GDPR.

Similarly, our external e-marketing systems are GDPR-compliant and do not access your personal data.

Data transfer to and from our webshop is secured with SSL encryption.

Design8’s local computers, including laptops used off-site, are continuously monitored and secured with user accounts protected by regularly changing passwords. Data stored on hard drives is encrypted.

General passwords are changed regularly and when personnel changes occur.

What We Do in Case of a Data Breach

Within 72 hours of discovering a data breach, Design8 will:

  • Report the breach to the Autoriteit Persoonsgegevens; (Dutch Data Protection Authority).
  • Report the breach to the police.
  • Take all possible technical and financial measures to address the breach.
  • Notify affected individuals and suppliers.
  • Implement measures to prevent future breaches.
  • This procedure is documented and accessible to all Design8 employees.
We Take Responsibility

We accept responsibility for any proven damages caused by non-compliant processing of your personal data.

We Will Get Certified

We plan to obtain GDPR certification as soon as possible to confirm our compliance. Currently, certification is not yet available.

We Don’t Have Records of Processing Activities

While it is unfortunate, we are not required to maintain a record of Processing Activities as we have fewer than 250 employees.
